Libertarians fail to quality for West Virginia ballot

A U.S. District Court judge ruled today that a “lack of reasonable diligence” ultimately thwarted the Libertarian’s effort to win West Virginia ballot access for party nominee Bob Barr after the party filed suit against the state.

Judge John Copenhaver also ruled that the state’s requirement that candidates must collect signatures from two percent of voters did not violate the Constitution.

“It seems clear enough the Barr/Root campaign would have satisfied the two requirements had they commenced their efforts just two to three weeks earlier,” Copenhaver wrote, noting the compliance by other third parties, such as the Constitution Party this year and the Libertarian Party in 2004.
