Proposition 98, the California Property Owners and Farmland Protection Act, would also have banned cities and counties from enacting new rent-control ordinances and would have phased out out existing ordinances when current tenants depart. The less-restrictive Proposition 99, the Homeowners and Private Property Protection Act, prohibits government agencies from using eminent domain to take an owner-occupied home and transfer it to a private owner or developer. The proposition also allows homes to be seized to protect public health and safety, deal with criminal activity or in an emergency.
